1. Acceptance & Definitions

By accessing or using the One Day Creative platform ("Platform") operated by One Day Creative Limited (Company No. 08645664), registered in England and Wales ("we", "our", or "us"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you must not use the Platform.

In these Terms:

• "Platform" means the One Day Creative website, web application, and all related services operated by One Day Creative Limited.
• "Services" means the in-school workshops, video content, and subscription services we provide.
• "User" or "you" means any individual or organisation accessing or using the Platform.
• "Content" means all videos, materials, resources, and other intellectual property available through the Platform.

2. Account Terms

To access certain features of the Platform, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Promptly notify us of any unauthorised access to your account

If you are registering on behalf of a school or organisation, you confirm that you have the authority to bind that organisation to these Terms. The organisation is responsible for managing user access and ensuring all users under its account comply with these Terms.

3. The Services

One Day Creative provides the following services through the Platform:

• In-school Workshops: Creative educational workshops delivered in person at schools across the United Kingdom, bookable through the Platform.
• Video Platform: A library of on-demand educational video content available to subscribers for streaming within the Platform.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with reasonable notice where practicable.

4. Subscriptions & Payment

Access to the video library requires an active subscription. Subscriptions are available in various plans as described on our Video Pricing page.

• Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.
• All prices are quoted in pounds sterling (GBP) and are exclusive of VAT unless otherwise stated.
• Payment is processed securely through our third-party payment provider, Stripe. We do not store your full payment card details.
• We may change our prices from time to time. Any price changes will take effect at the start of your next billing period, and we will notify you in advance.

5. Acceptable Use

You agree to use the Platform and Services responsibly. You must not:

• Share your login credentials with others or allow multiple individuals to use a single account (unless your plan expressly permits it)
• Download, record, screenshot, or otherwise capture video content from the Platform
• Redistribute, republish, or share any Content from the Platform with third parties
• Use the Platform for any unlawful purpose or in violation of any applicable laws or regulations
• Attempt to gain unauthorised access to any part of the Platform, other accounts, or our systems
• Use automated tools, bots, or scrapers to access or extract data from the Platform

6. Intellectual Property

All Content on the Platform — including videos, workshop materials, graphics, logos, text, and software — is owned by or licensed to One Day Creative Limited and is protected by copyright and other intellectual property laws.

Your subscription grants you a limited, non-exclusive, non-transferable licence to stream video content for educational use within your school or organisation. This licence does not permit downloading, copying, or redistribution of any Content.

All trademarks, service marks, and trade names displayed on the Platform are the property of One Day Creative Limited or their respective owners.

7. Data Protection

We are committed to protecting your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. For full details on how we collect, use, and safeguard your information, please refer to our Privacy Policy.

By using the Platform, you consent to the collection and processing of your data as described in our Privacy Policy. We process data on the lawful bases of contract performance, legitimate interests, and consent where applicable.

8. Children & Safeguarding

The Platform is designed for use by teachers, school administrators, and educational professionals. We do not provide accounts directly to pupils or children.

Schools are responsible for supervising the use of our Content in the classroom and ensuring compliance with their own safeguarding policies. If you believe a child has provided us with personal information without appropriate consent, please contact us immediately at hello@onedaycreative.co.uk.

9. Service Availability

We strive to keep the Platform available at all times but do not guarantee uninterrupted access. The Platform may be temporarily unavailable due to:

• Scheduled maintenance (we will endeavour to provide advance notice)
• Unplanned outages, technical failures, or circumstances beyond our reasonable control
• Updates and improvements to the Platform

We shall not be liable for any loss or inconvenience caused by temporary unavailability of the Platform.

10. Cancellation & Refunds

You may cancel your subscription at any time through your account settings or by contacting us. Upon cancellation:

• You will retain access to the video library until the end of your current billing period.
• No refunds will be issued for partial billing periods unless required by law.

For in-school workshop bookings, our cancellation and refund policy will be communicated at the time of booking. Please contact us directly to discuss any workshop cancellations.

11. Limitation of Liability

To the fullest extent permitted by law, One Day Creative Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform or Services.

Our total liability to you for any claim arising from these Terms or your use of the Services shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

12. Termination

We may suspend or terminate your access to the Platform immediately, without prior notice, if:

• You breach any provision of these Terms
• We reasonably suspect fraudulent or unlawful activity on your account
• Your continued use poses a risk to the security or integrity of the Platform

Upon termination, your right to use the Platform ceases immediately. Any provisions of these Terms which by their nature should survive termination shall continue in effect, including intellectual property rights and limitation of liability.

13. Changes to Terms

We may update these Terms from time to time to reflect changes in our Services, legal requirements, or business practices. When we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, where appropriate, sending you an email notification.

Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the Platform and cancel your subscription.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
